Welcome to malvêtu.

These Terms of Service govern your access to and use of malvetu.com, and any purchase made through the website.

By visiting the website, placing an order, creating an account, contacting customer care, or interacting with our services, you agree to these Terms. Please read them carefully before placing an order.

These Terms should be read together with our Shipping & Delivery, Cancellation Policy, Returns & Exchanges, Refund Policy, Privacy Policy, Cookie Policy, and Legal Notice.

Throughout these Terms, “malvêtu,” “we,” “us,” and “our” refer to the legal operator of malvetu.com.

2. Brand and products

malvêtu is a premium apparel brand offering fashion products, including T-shirts and, where available, related apparel and accessories.

Our products are intended for personal use and lawful purchase. Product availability, colors, sizes, materials, fit, measurements, and details may vary by item and by collection.

We may update, modify, discontinue, limit, or remove products at any time.

3. Website use

You agree to use malvetu.com lawfully and respectfully.

You must not:

  • use the website for fraudulent, unlawful, abusive, or harmful activity

  • interfere with website security, checkout systems, payment systems, or customer accounts

  • scrape, copy, harvest, or extract website content for commercial use

  • upload or transmit malicious code

  • attempt unauthorized access to our systems, accounts, or data

  • use false customer information

  • place orders using stolen, unauthorized, or fraudulent payment methods

  • misuse promotional codes, refunds, returns, chargebacks, or customer service processes

  • copy or imitate malvêtu content, visuals, product presentation, or brand assets

We reserve the right to restrict access, refuse service, cancel orders, or take appropriate action if website use appears fraudulent, abusive, unlawful, or harmful to the brand, our customers, or our partners.

4. Eligibility

By placing an order, you confirm that you are legally able to enter into a purchase contract in your country, state, province, or territory.

If you are under the age of majority where you live, you may use the website only with the involvement and consent of a parent or legal guardian.

5. Product information and presentation

We make reasonable efforts to present our products accurately.

However, product images, colors, proportions, texture, garment finish, print appearance, and scale may appear differently depending on screen settings, lighting, photography, device display, garment characteristics, and production variables.

Slight variations may occur in:

  • color appearance

  • fabric tone or finish

  • garment measurements

  • print placement

  • print scale

  • texture

  • stitching or construction details

  • product packaging

  • care label or manufacturing details

These variations do not automatically mean that a product is defective. Where a product is damaged, defective, misprinted, or incorrectly supplied, our Returns & Exchanges and Refund Policy will apply.

6. Sizing and fit

Customers are responsible for reviewing the relevant size guide before placing an order.

Sizing may vary by product type, garment cut, fabric behavior, fit intention, and measurement method. Product measurements are provided as a guide and may allow for reasonable manufacturing tolerance.

If you are between sizes, prefer a certain fit, or are unsure about measurements, review the product page and size guide carefully before ordering.

A wrong size selected by the customer may not qualify for a free return, exchange, or refund unless required by applicable law or unless the product received is incorrect, damaged, defective, or materially different from what was ordered.

7. Product care

Customers are responsible for following the care instructions provided with the product or on our Product Care page.

Damage caused by improper washing, drying, ironing, storage, cleaning products, excessive heat, rough handling, or use outside ordinary garment care may affect eligibility for replacement, exchange, or refund.

This does not affect rights that cannot be limited under applicable consumer protection law.

8. Orders and order acceptance

When you place an order, you make an offer to purchase the selected product or products under these Terms.

After you place an order, you may receive an order confirmation email. This confirms that we have received your order. It does not always mean that the order has been accepted, produced, fulfilled, or shipped.

We reserve the right to review, refuse, cancel, or limit any order where there is:

  • suspected fraud

  • payment risk

  • incorrect customer information

  • incorrect shipping address

  • pricing or product error

  • promotional misuse

  • unusual order activity

  • production limitation

  • inventory limitation

  • fulfillment restriction

  • legal or compliance concern

  • unauthorized resale concern

  • chargeback or abuse history

If we cancel an order after payment has been captured, we will refund the cancelled amount through the original payment method where possible.

9. Customer information

You agree to provide complete and accurate information when placing an order.

This includes:

  • name

  • email address

  • billing address

  • shipping address

  • phone number, where requested

  • payment information

  • size, color, and product selection

malvêtu is not responsible for delays, failed delivery, returned packages, or additional costs caused by incorrect or incomplete customer information.

If you notice an error after placing an order, contact hello@malvetu.com immediately. Changes may only be possible before the order enters production or fulfillment.

10. Prices, taxes, and currency

Prices are displayed on the website in the currency shown at checkout.

Prices may change without notice. The price charged is the price shown at checkout at the time the order is placed, unless there is an obvious error.

Depending on your location, prices may include or exclude VAT, sales tax, GST, duties, or other applicable charges. Any taxes, duties, import fees, customs fees, carrier charges, or local charges not collected at checkout may be the customer’s responsibility.

11. Payment

Payment must be made using the payment methods available at checkout.

By submitting payment information, you confirm that you are authorized to use the selected payment method.

Orders may be subject to payment authorization, fraud screening, security review, and verification. We may refuse or cancel an order if payment cannot be verified or if the transaction appears suspicious.

12. Production and fulfillment

Many malvêtu pieces are produced after order confirmation through professional production and fulfillment partners.

Production time is separate from shipping time. After an order is placed, it may enter preparation, production, fulfillment, quality handling, packing, and carrier transfer.

Once an order enters production or fulfillment, changes and cancellations may no longer be possible.

13. Shipping and delivery

Shipping options, costs, and estimated delivery times are shown where available during the shopping or checkout process.

Delivery estimates are not guaranteed unless expressly stated. Delivery may be affected by production time, carrier operations, customs processing, holidays, weather, public events, incorrect addresses, remote locations, or other circumstances outside our direct control.

Tracking information may be provided when available. Tracking updates can take time to appear after a shipping label is created.

14. International orders, customs, and duties

malvêtu may sell to customers in the United States, United Kingdom, Canada, Australia, and other eligible destinations where available.

International orders may be subject to customs duties, import taxes, VAT, GST, handling fees, carrier fees, brokerage fees, or local charges. These charges are set by local authorities or carriers and may be payable by the customer unless expressly collected at checkout.

We are not responsible for delays caused by customs, import checks, local authorities, or unpaid import charges.

15. Cancellations

Orders may be cancelled only where cancellation is still operationally possible.

Because many malvêtu pieces are produced after order confirmation, the cancellation window may be short. If you need to cancel or correct an order, contact hello@malvetu.com immediately after placing the order.

Once an order has entered production or fulfillment, cancellation, size changes, color changes, address changes, and product changes may no longer be available.

16. Returns, exchanges, and refunds

Returns, exchanges, and refunds are governed by our Returns & Exchanges and Refund Policy.

Eligibility may depend on:

  • the product condition

  • whether the item is unworn and unwashed

  • whether the item is returned in its original condition

  • whether the issue concerns size selection, change of mind, damage, defect, misprint, wrong item, or delivery problem

  • the time since delivery

  • the customer’s location and applicable consumer law

Nothing in these Terms limits statutory rights that cannot legally be limited.

17. Damaged, defective, misprinted, or wrong items

If you receive an item that appears damaged, defective, misprinted, or different from what you ordered, contact hello@malvetu.com as soon as possible.

Please include:

  • order number

  • full name

  • email address used at checkout

  • clear photos of the item

  • clear photos of the issue

  • photo of the packaging where relevant

  • brief description of the problem

We will review eligible claims and, where appropriate, may offer a replacement, exchange, refund, or other remedy in accordance with our policies and applicable law.

18. Lost, delayed, or returned packages

If a package appears delayed, lost, or returned to sender, contact customer care at hello@malvetu.com.

We may request confirmation of the shipping address, tracking information, carrier status, and any delivery notices.

If a package is returned due to an incorrect address, refused delivery, unpaid customs charges, failure to collect, or unavailable recipient, additional shipping charges may apply for reshipment where reshipment is available.

19. Promotions, discounts, and offers

Promotional codes, discounts, credits, gifts, and offers may be subject to conditions, exclusions, expiration dates, minimum order values, product exclusions, region restrictions, and usage limits.

Promotions may not be combined, transferred, redeemed for cash, or applied retroactively unless expressly stated.

We may modify, suspend, refuse, or cancel any promotion where there is misuse, technical error, suspected fraud, abuse, or unintended application.

20. Gift cards

If malvêtu offers gift cards, gift card purchases and use may be subject to separate terms, including redemption rules, expiry rules where legally permitted, fraud checks, and regional restrictions.

Gift cards cannot be used unlawfully, resold commercially without permission, or used for fraudulent activity.

21. Accounts

If customer accounts are available, you are responsible for keeping your login details secure and for all activity under your account.

We may suspend or close an account where there is suspected fraud, abuse, security risk, violation of these Terms, or unlawful activity.

22. Electronic communications

By placing an order or contacting us, you agree that we may communicate with you electronically regarding your order, account, customer service request, policy updates, and legally required notices.

Marketing communications will be sent only where permitted by law and may be unsubscribed from according to the instructions provided in those messages.

23. User-generated content

If you tag, mention, send, submit, upload, or share content involving malvêtu, including photos, videos, comments, reviews, captions, messages, or social media posts, you confirm that you own the rights to that content or have permission to share it.

malvêtu may request permission to use customer or creator content for editorial, social, advertising, website, email, or brand purposes. If separate UGC terms are published, those terms will apply.

You must not submit content that is unlawful, defamatory, abusive, obscene, misleading, infringing, hateful, threatening, or invasive of another person’s privacy.

24. Influencers, affiliates, and brand relationships

Creators, influencers, affiliates, ambassadors, partners, or customers who receive payment, commission, gifted products, discount codes, early access, store credit, or any other benefit from malvêtu must clearly disclose that relationship when posting or promoting malvêtu.

Disclosures must be clear, visible, and understandable to the audience.

25. Intellectual property

All content on malvetu.com and official malvêtu channels is owned by or licensed to malvêtu unless expressly stated otherwise.

This includes:

  • brand name

  • logos

  • product names

  • garment artwork

  • product photography

  • campaign imagery

  • website copy

  • product descriptions

  • graphics

  • layout

  • styling

  • visual identity

  • video content

  • emails

  • advertisements

  • packaging visuals

  • social media assets

You may not copy, reproduce, distribute, modify, sell, publish, imitate, scrape, frame, or commercially use any malvêtu content without prior written permission.

26. Brand protection, counterfeit activity, and unauthorized resale

malvêtu products and brand assets may not be used to create counterfeit products, imitation listings, fake stores, unauthorized advertisements, misleading resale pages, unauthorized commercial campaigns, or any presentation that may confuse customers about authenticity, origin, sponsorship, or official status.

We may refuse, cancel, restrict, or investigate orders that appear connected with unauthorized resale, counterfeit activity, fraudulent activity, commercial misuse, or brand impersonation.

Nothing in this section prevents lawful consumer rights that may apply in your jurisdiction.

27. Third-party services and links

The website may contain links to third-party websites, platforms, payment providers, shipping tools, apps, or services.

Third-party services are operated by their respective providers and may have their own terms and privacy policies. malvêtu is not responsible for the content, practices, policies, availability, or performance of third-party websites or services.

28. Errors, inaccuracies, and availability

We may correct errors, inaccuracies, or omissions at any time.

This may include errors related to pricing, product descriptions, measurements, availability, promotions, shipping information, taxes, images, or checkout details.

If an error affects an order, we may contact you, cancel the affected order, correct the order, or offer another appropriate resolution.

29. Chargebacks, fraud, and abuse

We take payment fraud, chargeback abuse, return abuse, promotional misuse, and false claims seriously.

We may refuse service, cancel orders, limit purchases, suspend accounts, or provide order records, shipment records, tracking information, customer communications, and relevant evidence to payment providers, fraud prevention services, carriers, legal advisers, or authorities where appropriate.

30. Disclaimer of warranties

The website and products are provided in accordance with these Terms, product descriptions, and applicable consumer protection law.

To the fullest extent permitted by law, we do not make additional warranties beyond those expressly stated on the website or required by applicable law.

This section does not exclude, restrict, or modify any consumer guarantee, statutory warranty, or legal right that cannot be excluded, restricted, or modified.

31. Limitation of liability

To the fullest extent permitted by law, malvêtu is not liable for indirect, incidental, special, punitive, or consequential losses, including loss of profit, loss of revenue, loss of data, loss of opportunity, or reputational loss arising from use of the website, delayed delivery, unavailable products, or purchase of products.

Nothing in these Terms limits liability where it would be unlawful to do so, including liability for fraud, intentional misconduct, or consumer rights that cannot legally be limited.

32. Indemnity

You agree to indemnify and hold malvêtu harmless from claims, losses, liabilities, damages, costs, or expenses arising from your misuse of the website, violation of these Terms, fraudulent activity, infringement of intellectual property rights, unlawful content submission, or unauthorized commercial use of malvêtu assets.

This section applies only to the extent permitted by applicable law.

33. Statutory consumer rights

Nothing in these Terms is intended to limit, exclude, or reduce consumer rights that cannot legally be limited, excluded, or reduced.

Customers in different countries, states, provinces, or territories may have mandatory rights relating to defective goods, misdescribed goods, refunds, repairs, replacements, cancellations, delivery, or other consumer protections.

Where these Terms conflict with mandatory consumer protection law, the mandatory law will apply.

34. Governing law

These Terms are governed by the laws applicable to the operator in Germany, unless mandatory consumer protection laws in your country, state, province, or territory provide you with additional rights that cannot legally be waived.
